- Niels Nielsen was the taxpayer on Riseg?rd, 27 Slg. Olsker, in 1662. According to his mother's probate in 1681 he held the office of Reeve (Sandemand) for North District (Nordre Herred). From his first marriage to Martha Rasmusdatter there was one son, named Niels Nielsen (c.1658-1737) of Bridsensg?rd, 9 Slg. Olsker.
His second marriage was to Kirstine Samsingsdatter. There are two children mentioned in his probate of December 29, 1700: Samsing and Bendte; a second daughter Kirstine Nielsdatter must have been born after the probate, see below. Jens Wefstsen officially took over Skovg?rd, 4 Slg. in Olsker parish in 1716.

From the above probate we can see that Kirstine Nielsdatter was born after her father's death and subsequent probate hearing. Proof that she is the daughter of Niels Nielsen and Kirstine Samsingsdatter can be found in the probate held after her first husband Mogens Poulsen's death; in which her brother is said to be Wefst Jensen Schou - Kirstine Samsingsdatter's son from her second marriage. His probate states: January 8, 1738, page 171, Mons Poulsen, Allinge. Enke: Kierstine Nielsdatter, hendes laugv?rge: broder Wefst Jensen Skou. February 12, 1701, page 188a: Artillerymaster Peder Michelsen read an order from Judge Ancher M?ller, in Governor Reedse's absence, to go into the rights on behalf of Niels Nielsen of Olsker against his stepmother Kirstine, the widow of Niels Nielsen. Peder Michelsen had summoned Niels Nielsen's widow Kirstine of the 4th farm in Olsker and her guardian Wefst Pedersen before an eight-man inquiry so that heirs could know what is due to them in the succession and who has access (the right) to take over the farm. Also called were the deceased's children's guardians: Hans Svendsen of Rutsker and their mother's brother Samsing Samsingsen in Aakirkeby. Niels Nielsen's widow Kirstine was pregnant and an heir was on the way. Wefst Pedersen believed that there should be elected men to oversee this case until the baby was born. It was important to know whether it was a boy or girl depending on Book 5, Chapter 2, Article 12. Kirstine complained about her stepson Niels Nielsen - this was money wasted. Furthermore, she believed that the 23 Slettedaler, which her husband passing had cost was payable by the estate. The widow invoked the right to sit in undivided possession of estate until she had given birth. In the probate there had been no question that it was the deceased who was the child's father. The widow Kirstine also requested of the governor another representative than that of Wefst Pedersen, who she thought was an old man and hard of hearing. There were many things which Wefst Pedersen did not understand. The magistrate could not remove the widow's guardian Wefst Pedersen from his duty. The magistrate was aware that there could be true succession as soon as was known wether the widow carried a son or a daughter. Both parties requested a court judgement.
June 3, 1701, page 206a: Artillerymaster Peder Michelsen had the governor and the high court judge orders to investigate the true rights on behalf of Sergeant Niels Nielsen of Olsker in the case against his stepmother Kirstine, the widow of Niels Nielsen, on the 4th farm. The case was not brought to a conclusion when the widow Kirstine's guardian brought forth the case and the widow was pregnant. The widow was now reembursed and the case could be pursued. Hans Hiort had the governor's order and county notary's permission to go into right's of the widow Kirstine. Hans Hiort stated that the probate from December 1700 had been quickly settled, since there was taken into account the legacy to the fetus, which she carried after her late husband. The widow also complained about the probate's specifying the grain for impurities of straw and funeral expenses she claimed totaling 73 Sdr. Furthermore, there is the rightful inheritance of her two surviving children with the deceased. The magistrate announced thereafter an eight man jury to re-evaluate the case. The chairman was Peder Bendsen, Anders Hansen of K?rseg?rd in Klemensker, Niels Hartvig and Peder Hansen of Rutsker, Peder Ibsen and Henning Kj?ller of Olsker, and Peder Espersen and Peder Hansen of R?. The inspection should happen at the premises on June 11th. Niels Nielsen had given proper summons to Kirstine Samsingsdatter and the matter was now to be undertaken.
June 25, 1701, page 215a: Peder Nielsen of ?sterlars parish came on behalf of Niels Nielsen of Olsker in the case against his stepmother Kirstine on the 4th farm in Olsker parish. He produced Laurids Mogensen of Borregaard (= Tuleborg, 10 Slg. Rutsker), who was 64 years old. He told that in the year 1689 when the 4th farm burned. He did not know why it burned, but it was soon after that Niels Nielsen's wife Martha Rasmusdatter died. This same woman had a brother named Hans Rasmussen, with whom she had inherited the farm. When Hans Rasmussen died Martha inherited the farm and his personal property. Also the 9th farm (Bridsensg?rd). Laurids Monsen thought it was Sergiant Niels Nielsen and Martha Rasmusdatter, who was the rightful owner of the farm. After the fire, the farm was built up again, but Laurids Mogensen did not know if it was wood from the farm's forest, but he could, however, indicate that the forest had been cut in the last 12 year's time. Sergeant Niels Nielsen and Martha lived on Bridsensg?rd before moving to the 4th farm. Niels Nielsen junior took over Bridsensg?rd. Laurids Mogensen could not disclose what existed of goods and funds, since Niels Nielsen had married Kirstine Samsingsdatter. Mogens Jensen of Habedam in Olsker was 50 years old and he stated that the 4th farmhouse burned down 11 or 12 years ago. He confirmed Laurids Mogensen's report and added that he knew of no contract between Niels Nielsen senior and junior. He knew that Kirstine Samsingsdatter paid for the building of the western and southern wing's construction, and that Sergeant Niels Nielsen left a fully finished 9th farm, Bridsensg?rd, to his son Niels Nielsen, who he believed was the sole heir after Niels Nielsen and Martha, who was then an adult and his own guardian. Mogens Jensen was convinced that the timber was cut from the farm's own forest land, and that Sergeant Niels Nielsen's mother was the heir after her brother Hans Rasmussen. Hans Hiort promised, on the widow Kirstine Samsingsdatter's behalf, to complete his observations so that the case could go to appeal.
July 15, 1701, page 223a: Hans Hjort on Niels Nielsen's widow Kirstine's behalf summoned Niels Nielsen of Bridsensg?rd. The purpose was so that both the 4th and 9th farm should be involved in the case. There should be examined the debts that had been repaid by the widow and others. Several witnesses were summoned: Mogens Poulsen and Mogens Svendsen in Olsker, Hans Svendsen in Rutsker, and Hans Larsen in Allinge. Furthermore, the valuation experts from Niels Nielsen's probate, as there was doubt about how much grain there had been. Niels Nielsen told that the contract with the farms was made approximately 1-1/2 years before his father Niels Nielsen was married to Kirstine Samsingsdatter.
Hans Svendsen at the 2nd farm in Rutsker told that the fire at the 4th farm happened in 1689 and shortly thereafter Niels Nielsen came to the Hans Svendsen "og jamrede sig ynkeligt" (and wailed pitifully) and asked Hans Svendsen to pay his workers and provide seed. Hans Svendsen loaned him some money, bread and preserved food, also seed and grain. Niels Nielsen place as deposit on this some copper: a brewing kettle and a distilling pan. A mortgage given to Hans Svendsen. When Niels Nielsen came into marriage with Kirstine he redeemed the distilling pan for 17 Sdr. The wife had agreed to pay. The brewing kettle was picked up somewhat later - perhaps 4 or 5 years ago.
Next Mogens Poulsen told that after Niels Nielsen had come into marriage with Kirstine had he set up the western wing of Skovg?rd, which totaled 11 room timber posts. He had helped to cut the wood and he had been paid. He had cut timbers for 3 room timber posts which were set into the eastern end of the main house, with attic and basement below. For this chopping and cutting work he was paid 4 Sdr. Mogens Poulsen also had sawn 5 cords of firewood and made thereof benches, doors, windows, and built the ceiling on the 3 new room timber posts. For this work he had received 7 Sdr. He received payment in cash, steers and clothing. The final payment was made "siden Niels Nielsen afgik ved d?den" (after Niels Nielsen had died). The last work on the farm had happened about 2 years ago. The wood was cut in the 4th farm's forest. The witness could not confirm reports that the wood from the forest was sold, to get money for the construction. Niels Nielsen did not believe that Kirstine Samsingsdatter had brought more than 16 Daler into the marriage. The witness knew nothing about this.
Mogens Svendsen said he had helped with the timber, which Mogens Poulsen had spoken about. He had helped to cut down trees in the 4th farm's forest. He had been to set up the 11 room timber posts in the western wing, and the ceiling on the east end of the farm house's 3 room timber posts. For this work he was paid by Niels Nielsen 6 Sdr. in goods and money. Mogens Svendsen was aware that Niels Nielsen had sold a few wagon loads of firewood and a few pieces of wood to others.
Hans Larsen Smed from Allinge told that Niels Nielsen's widow Kirstine had paid him for the fittings for her late husband's coffin with a total of 3 Daler, a sum which he was to receive as 2 barrels of oats, 1 load of firewood and 6 Mark in cash. He had bought the widow to the N?rre Herredsting assembly for this payment.
Peder Pedersen Rutsker told that he was the threshing man during the probate for Niels Nielsen. After the harvest was measured 16 acres of barley and 16 acres of oats on Kirstine Samsingsdatter's threshing floor. Threshing wages were measured by barrels of oats or other grains. Ole Andersen worked with Peder Pedersen to thresh barley and oats and he could confirm that there were 16 barrels of each.
Hans Hiort presented a certificate issued by Barbara, widow of Christopher Hansen, of R?nne on July 14, 1701 worth 25 Daler 1 Mark 12 Skilling. Furthermore, Hans Hiort presented a bond of 40 Daler which Niels Nielsen had issued on July 21, 1689 to Mogens Mogensen senior of Klemensker. The bond was paid and settled. Hans Michelsen admitted that he had received two Daler in the form of butter for a debt of the same amount dated June 6, 1699.
July 29, 1701, page 226a: Wefst Pedersen submitted proper notifications to Niels Nielsen of Olsker and assembly witnesses from April 6 and June 15, 1701. Wefst Pedersen asked for Niels Nielsen to present his parents probate contracts to see what was the value of the 9th farm. Peder Bendtsen on his own and others behalf asked that the same be submitted to examine the value of the 4th farm.
August 5, 1701, page 229b: Peder Michelsen, as appointed proxy for Sergeant Niels Nielsen in the matter between him and his stepmother. Peder Michelsen summoned the stepmother Kirstine Samsingsdatter who lived on the 4th farm in Olsker, along with her guardian Hans Svendsen of Dyndeg?rd in Rutsker, Samsing Samsingsen of ?ker parish, and Corporal J?rgen Gi?dich from Nylarsker parish. The hearings were part of the case regarding the inheritance and access to the 4th farm, where there was an 8 man evaluation. In addition, the following witnesses were called: Captain J?rgen Pederen, Hans Andersen, Hans Hansen, Hans J?rgensen, all from Olsker parish, Hans Jensen and Anne Hendrichs of Rutsker, with her guardian, and Mogens Mogensen of Mure in Klemensker parish. Hans Hiort, on Kirstine Samsingsdatter's behalf, protested the summons and felt that the application was illegal. After a lengthy discussion the hearing was postponed to the next assembly. Wefst Pedersen of Olsker parish summoned Sergeant Niels Nielsen of Bridsensg?rd in Olsker to get him to publicly share what he had against Wefst Pedersen. Niels Nielsen had spoken numerous words against him. Niels Nielsen was not present and Wefst Pedersen would take the case to the next assembly.
August 19, 1701, page 231a: Hans J?rgensen from Olsker told that the night the 4th farm burned, he and his father J?rgen Pedersen asked Niels Nielsen's servant Ole Andersen if anything was rescued from the fire. The servant boy said: yes, all the cattle of the northern wing and four calves. Then the witness and his father and Hans Hansen of the 7th farm in Olsker rode to Mogens Jensen of Habedam where Niels Nielsen senior was. Witness's father, Captain J?rgen Pedersen, asked Niels Nielsen if he had anything with him. Niels Nielsen had lifted his hands and said: nothing other than what he was carrying, a shirt and two pants. They promised to ride back and see if they could save his strongbox.
Ole Andersen had saved the strongbox from the fire, but there was burnt a hole in one corner. The witness and Hans Hansen saw that it contained "heelle penge og s?lf, som var en liden s?lfskaal og en s?lfske" (all the money and silver, which was a little silver bowl and a silver spoon): but they did not know how much money it was. Peder Michelsen said to the witness that it was quite known that there were rescued 16 cows, 30 sheep, 2 brew kettles, a distilling pot in addition to three or four copper stills, an iron stove, eight or ten pigs, eight birds. The witness replied that he had heard that there were rescued 15 cows, which good people had gone to save. He also knew that the endangered were all rescued, along with the iron stove and brew kettle which was in the wall and one which was in the basement, where there was meat sooking, a distilling pan which was damaged as it was in the wall. All items stood in the woods that night. The witness confirmed that timber for the farm, which was rebuilt after the fire, came from the farm's own forest. The witness also confirmed having heard that the deceased Martha Rasmusdatter inherited the farm, free of charge after her brother Hans Rasmussen, and that it therefore came in Niels Nielsen's ownership since he was married to Martha. The farm was fully equipped with cattle. In rebuilding the farm the craftsmen were paid with wood from the forest. The witness said that Niels Nielsen had told J?rgen Pedersen of Brog?rd that he had not been given in dowry other than a cow, which he even gave back to his wife's mother. The witness Hans J?rgensen said that before the fire the forest was so good that when you cut down a tree, it could not fall to the ground because of the trees stood so close. The witness could not fail to say that the 4th farm was largely Niels Nielsen junior's mother's farm. Peder Michelsen believed that all that the witnesses had reported was "murmel snak" (grumbling talk) and that it was not true.
Next, Anne J?rgensdatter, living on Hans Svendsen's 18th farm's land, was questioned. She had heard at the time Hans Rasmussen lay in his sick bed that he had given Niels Nielsen senior 200 Sdr. when he married his sister Martha Rasmusdatter and that same money should redeem the 9th farm, Bridsensg?rd, so that the the heirs could stay there. She had also heard Niels Nielsen thank his brother-in-law for that amount. It was not the only time she had heard the story. Hans Hiort referring to the farm documents told another story about Bridsensg?rd and he believed, that Niels Nielsen junior honestly could tell, that there was a contract on Bridsensg?rd and Skovg?rd that describes this. Anne J?rgensdatter told also that Kirstine Samsingsdatter had nothing other than a mare and a few clothes when she came to the 4th farm, which she thought was Martha Rasmusdatter's farm, which she had inherited from her brother.
Hans Jensen from Rutsker told that he served at the 4th farm when Niels Nielsen inherited the farm after his wife's brother Hans Rasmussen. Niels Nielsen lived at that time in Bridsensg?rd and he was not sure where to live. It was Martha Rasmusdatter who wanted them to move to the 4th farm, as it was her brother's farm and she would stay there as long as she lived. Martha inherited the farm with full livestock, cattle, beasts and seeds. The trees in the forest were used to rebuild Skovg?rd after the fire, and workmen were paid in wood from the forest. On several occasions, Hans Rasmussen told him that he had given money to Niels Nielsen, so that he could buy Bridsensg?rd. He could also report what was saved during the fire: 14 or 15 cows, 7 birds, 26 old sheep, 2 copper kettles, a distilling pan without rings, hats and pipes because they burned, and an iron stove. Kirstine Samsingsdatter brought a cow, a horse and a mare with her into her marriage.
Then Boel Andersdatter, who worked for J?rgen J?rgensen in Olsker, told that Niels Nielsen had told her that Kirstine Samsingsdatter had brought to her marriage a cow, a horse, a mare, bedding, a duvet and a bench quilt.
Mogens Mogensen of Mure in Klemensker said he had lent Niels Nielsen senior 20 Sdr. when he had brought an action against Laurids Monsen's and Christen Pedersen's sons. Morten Bohn had other 20 Sdr. standing in Skovg?rd. Hans Svendsen in Dyndeg?rd in Rutsker described what had been redeemed and how much money was still due.
Hans Hiort presented a royal request leter dated December 4, 1689, wherein Niels Nielsen talks about the unhappy event of the fire that took place during the night of 14th and 15th November, 1689.
The district judge asked the parties to complete their questioning at the next session, so that the eight men could submit their assessment.
August 26, 1701, page 235a: Sergeant Niels Nielsen properly entered a written submission for the 8 man jury. The other party, represented by Hans Hiort, also entered a submission. Hans Hiort demanded from Niels Nielsen that he should hand over all the letters and documents that were on the farms Skovg?rd and Bridsensg?rd. He believed that the eight jurymen were being kept ignorant of the facts. Notably, a document issued September 19, 1690 was requested. They had to be registered at the N?rre Herredting on September 26th.
The dispute between Niels Nielsen and Wefst Pedersen regarding exchange of words in the County Council, regarding the case between Wefst Pedersen and Berild Clausen was taken up. Niels Nielsen gave his description of the case. Wefst Pedersen thought it was a distortion of the facts. Niels Nielsen had accused him of a number of falsehoods regarding field stones and boundary stones. And in this regard, he said that Wefst Pedersen had committed "us?mmelige" (indecent) acts. The bailiffs had heard it, but that they could not in good conscience explain what Niels Nielsen meant by that. Words such as "despyt og skamflech" (argumentative and scornful) had been used against Wefst Pedersen. Wefst Pedersen would have Niels Nielsen had to make oath that he had never said dishonorable words in the king's law against him. The magistrate would give judgment at the next session.
September 2, 1701, page 242a: Judgment was given by the magistrate was that he could not see that Wefst Pedersen had proven that Sergeant Niels Nielsen had used obscene words against him, he ordered Niels Nielsen free of penalty.
September 23, 1701, page 243b: The chairman of the inspection of the 4th farm, Skovg?rd, in Olsker presented their conclussions, and issued the following documents: a mortgage bond of December 19, 1690, a probate dated December 29, 1700, one court testimony dated August 5, 1701 and a court testimony from July 15, 1701, court testimony from February 12, 1701. September 23, 1701, page 243b: Wefst Pedersen of Olsker summoned Niels Nielsen of Bridsensg?rd to get him to submit the judgment of the Niels Nielsen believed to refer to August 19th. It was so awful Wefst Pedersen would apply to the king to redress this. Niels Nielsen did not know what Wefst Pedersen meant as he had heard of no judgment, nor had he mentioned a judgment of Wefst Pedersen. But it could be Berild Clausen's case of Sivertsl?kken which Wefst Pedersen brought against him. It could be here that misunderstandings arose. It was in county court on 21 June (July 22!) that Berild Clausen's writing had insulted Wefst Pedersen.
Four men judgement (page 245b) after and inspection on June 11, 1701 of the 4th farm in Olsker produced an assessment of the house, building, fields and meadows, forest and "herlighed" (glory-right = labour ogligation).
The above judgement gave an evaluation on the farmhouse at 100 Daler 2 Mark, for the arable land: barley land of 12 t?nder land at 12 Daler, oats land which the widow and neighbours thought was 18 t?nder land at 18 Daler, and meadow at 40 Daler. The labour obligation for the cabbage garden, small fish ponds, woodland and forest vegetation, as well as the clover was set at a total of 120 Daler. A sum total of 290 Daler 2 Mark. From the debt was deducted 140 Daler to Morten Bohn in Hasle after the mortgage of December 19, 1690, the evaluator's fee of 6 Sdr. and the notary fee of 6 Daler. The remainder is to divided between the widow Kirstine Samsingsdatter, now married to Jens Wefstsen (her guardian Wefst Pedersen's son!), and the deceased's children. A total of 138 Daler, half of which goes to the widow, the other half portion to be shared between the two brothers and two sisters.
Next, the jurymen handed down judgment on who had accession rights to the farm. The widow Kirstine Samsingsdatter would keep the farm for life, then Niels Nielsen senior's youngest son, Samsing Nielsen, would take over the farm. Normally it would be the son from his first marriage (Niels Nielsen junior), who would take over the farm, but as he had instead taken over Bridsensg?rd, he therefore had no claim on 4th farm as well.
